The Customer agrees to access the website and to make appropriate use of it, its services, and its content in accordance with applicable law. In the event of a breach of this requirement or a breach of the terms and conditions set forth herein, BRACOMONTE EQUESTRIAN reserves the right to immediately revoke access to the website without prior notice. BRACOMONTE EQUESTRIAN reserves the right to add, remove, change, or modify, at any time, the layout, configuration, and location of the website, as well as the conditions required to use the website. Likewise, it reserves the right to modify the Terms and Conditions of Purchase at any time.

PURCHASE PROCESS

 

During the purchase process, the Customer must fully and unreservedly accept the Terms and Conditions of Purchase, which are provided in Spanish and English and will always be included via a link in the purchase confirmation email so that customers can save them for future reference.

 

To make a purchase at www.bracomonteequestrian.com, you must follow this process:

 

1. Select the products you wish to purchase from those offered by BRACOMONTE EQUESTRIAN on the website.

 

2. Once you have selected the product you wish to purchase, click the “ADD TO CART” button to add the product to your shopping cart. If you wish, you may continue adding more products to your shopping cart.

 

3. Once you have finished selecting products, click on “VIEW CART” in the top menu, and a summary listing the selected item(s) will appear. Finally, to proceed with your order, click the “CHECKOUT” button.

 

4. To complete the process, you can register and create a user account or place the order as a “guest.”

 

5. Finally, you must choose the shipping method and then the payment method for your order from those offered by BRACOMONTE EQUESTRIAN and click on “PROCEED TO PAYMENT.”

6. Once the purchase process is complete, BRACOMONTE EQUESTRIAN will send you an email with the details of your order. If you do not receive this email within 24 hours, please contact us. If you notice any errors in the information entered in your order, you can correct them through the following channels: by emailing hello@bracomonteequestrian.com.Por or via WhatsApp chat.

PRICES AND PAYMENT METHODS

 

The prices of our products are listed in euros, including taxes. When placing an order, the Customer may choose to pay for their purchases using any of the following payment methods:

 

Credit Card: via the payment gateway provided by a bank. The purchase process is facilitated with immediate confirmation, at no additional cost to the Customer, through the bank’s payment gateway, securely and seamlessly integrated with the online store’s checkout process. Accepted cards include: VISA, Mastercard, AMEX, Maestro.

 

PayPal: If this payment method is selected, the Customer will be redirected to the PayPal website at the time of “PROCEED TO PAYMENT” to complete the transaction using their PayPal account or directly via VISA, Mastercard, AMEX, or Maestro credit cards.

 

Bizum: via the payment gateway provided by a bank. The purchase process is facilitated with immediate confirmation, at no additional cost to the Customer, through the bank’s payment gateway, securely and seamlessly integrated with the online store’s checkout process.

 

We use SSL (Secure Socket Layer) technology. SSL encrypts and protects all data you send to us over the Internet.

 

The Customer guarantees that they are the owner of the information provided for product pickup or an authorized representative thereof; therefore, BRACOMONTE EQUESTRIAN assumes no liability in this regard.

BRACOMONTE EQUESTRIAN sends the Customer a confirmation email regarding their purchase. Once the product has been shipped, for orders within Europe, a digital invoice will be issued and sent to the Customer via email. However, the Customer may also request a paper invoice by sending an email to hello@bracomonteequestrian.com or via WhatsApp.

For shipments outside of Europe, the invoice will be included in paper format inside the product package.

 

RIGHT OF WITHDRAWAL

Customers who qualify as consumers or users pursuant to Article 3 of Spanish Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary legislation, may exercise their right of withdrawal.

BRACOMONTE EQUESTRIAN grants its customers a period of one hundred (100) calendar days from the date of receipt of their order to exercise this right.

The right of withdrawal shall not apply in the following cases, as established in Article 103 of the aforementioned Royal Legislative Decree:

  • The supply of goods made according to the consumer's specifications or clearly personalized.

  • The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.

Items must be returned in perfect condition, unused, unwashed, and with all original tags attached. Whenever possible, they should also be returned in their original packaging.

The refund of the purchase price will be processed once the condition of the product has been verified. Unless otherwise communicated, the refund will be made using the same payment method used for the original purchase and, in any event, within a maximum period of 14 calendar days from the confirmed receipt of the withdrawal request.

Once the withdrawal request has been received, BRACOMONTE EQUESTRIAN will provide the Customer with the necessary instructions for delivering the product to the designated collection point. The Customer must deliver the product without undue delay and, in any case, no later than 14 calendar days from the date on which they communicated their decision to withdraw.

The costs arising from the return of the goods as a result of exercising the right of withdrawal shall be borne by the Customer.

The Customer shall be responsible for any reduction in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics, or functioning.

BRACOMONTE EQUESTRIAN will assess the condition of the returned product. Where applicable, the Customer will be duly informed of any depreciation in the value of the product, which will always be justified on the basis of objective and verifiable criteria.

The costs arising from the return of the goods as a result of exercising the right of withdrawal shall be borne by the Customer.

The Customer shall be responsible for any reduction in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics, or functioning.

Bracomonte Equestrian will assess the condition of the product for which the right of withdrawal has been exercised. Where applicable, the Customer will be duly informed of the existence and amount of any depreciation in the value of the product, which shall in all cases be justified on the basis of objective and verifiable criteria.

DEFECTIVE, INCORRECT OR TRANSPORT-DAMAGED PRODUCTS

If a product is defective or does not correspond to the product ordered, the Customer may return it together with all of its accessories. Bracomonte Equestrian will bear the shipping costs incurred for both the delivery and the return of the product.

Bracomonte Equestrian will, where appropriate, resend the repaired or replacement product free of charge.

Upon receiving a request for the return of a defective, incorrect, or transport-damaged product, Bracomonte Equestrian will provide the Customer with the necessary instructions for delivering the product to the designated collection point. The Customer must deliver the product to the designated collection point without undue delay.

If the Customer chooses to return the goods using a carrier other than the one proposed by Bracomonte Equestrian, and the selected carrier charges higher shipping rates, the Customer shall be responsible for paying the difference in transportation costs.

The Customer may notify us of their intention to return a product for these reasons by sending an email to hello@bracomonteequestrian.com.

If the product has been damaged during transport, the Customer must notify us as soon as possible after receiving the order and, where possible, record the incident on the carrier's delivery note.

Upon receiving the order, and before opening the package, the Customer should verify that the packaging is in good condition. If any anomaly is observed before opening the product, the Customer is kindly requested not to break the seal or open the packaging.

If the Customer returns a product on the basis of an alleged defect or error and it is subsequently determined that no such defect or error exists, the cost of the return shall be borne by the Customer.

 

PRODUCT EXCHANGES

If you wish to exchange a product for another, please send an email to hello@bracomonteequestrian.com. Once your request has been received, BRACOMONTE EQUESTRIAN will provide you with the necessary instructions for delivering the product to the designated collection point.

The Customer must deliver the product to the designated collection point without undue delay and, in any event, no later than 14 calendar days from the date on which the exchange request is communicated.

The product must be returned in perfect condition, unused, unwashed, with all original tags attached and, whenever possible, in its original packaging.

The cost of returning the product to be exchanged shall be borne by the Customer. However, Bracomonte Equestrian will ship the replacement product free of charge.

If the new product has a lower price than the original product purchased, the difference will be refunded to the Customer. If the new product has a higher price, the Customer shall be responsible for paying the difference.

 

WARRANTY

The products offered by Bracomonte Equestrian are covered by a three (3) year warranty against manufacturing defects, starting from the date of delivery. This warranty does not cover damage resulting from improper use or normal wear and tear.

If any issue arises, Customers who qualify as consumers or users should contact us to report the matter. We recommend providing a detailed description of the problem and, where possible, supporting visual evidence such as photographs.

Upon receiving your request, we will respond as soon as possible to inform you of the next steps. Once the warranty claim has been accepted by the manufacturer, we will proceed accordingly.

In the event of a defective product, Bracomonte Equestrian will, where appropriate, repair or replace the product, provide a price reduction, or terminate the purchase contract. These remedies shall be provided free of charge to the consumer.

Bracomonte Equestrian shall be liable for any lack of conformity that becomes apparent within three (3) years from the date of delivery.

In all cases, Bracomonte Equestrian will bear all shipping and return costs arising from the warranty process.

Unless proven otherwise, the products shall be deemed to comply with these Terms and Conditions provided that they meet all of the following requirements:

  • They correspond to the description provided by the seller and possess the qualities of the product that the seller presented to the consumer, whether by sample or model.

  • They are fit for the purposes for which goods of the same type are ordinarily used.

  • They demonstrate the quality and performance that are normal for goods of the same type and that the consumer may reasonably expect, taking into account the nature of the product.

User Account Deletion

Customer Eligibility

The Customer may only enter into a contract if they are of legal age and/or have the legal capacity to enter into binding agreements.

If an order is placed by a minor, responsibility for such order shall rest with the minor's parents or legal guardians.

Governing Law and Jurisdiction

The parties agree that any disputes arising in connection with these Terms and Conditions shall be governed by Spanish law.

For Customers who qualify as consumers or users, the competent courts shall be those corresponding to the Customer's place of residence, in accordance with applicable legislation.

For all other Customers, the competent courts shall be those of Marbella (Málaga), Spain.

 

Online Dispute Resolution Platform

Customers who qualify as consumers or users in accordance with Article 3 of the Spanish General Law for the Protection of Consumers and Users (TRLGDCU) may submit their complaints through this Online Dispute Resolution platform.
